An original court writes:

Ignore this court that the original text dsell'art. 156 Criminal Code provided that "the right to remission is extinguished by the death of the victim of the offense" and that only after 1975, the Constitutional Court No 151 / 75 was allowed to the heirs, if they are all consenting, expressed a possible remission (never implied) of the complaint given by the deceased.
So the rule, in case of death of the plaintiff is contrary to what is considered by this court, which, with the death of the plaintiff, the complaint can not be called, or implied or explicit, unless all the heirs , agree, agree to rimetterela, which, in this case, it was not assumed by the original judge.
